KIN'NOTé's general conditions of sale and use define the rights and obligations of the parties in connection with the sale of KIN'NOTé products to the customer. The customer accepts the general conditions of sale as well as the rights and obligations relating thereto by placing an order on the kinnote.fr site,  on the KIN'NOTé shop hosted by Etsy  : www.etsy.com/fr/shop/KINNOTE.

or on any other sales platform  chosen by Kin'noTé.

Information about  KIN'NOTé prospects and customers collected on this site are subject to computer processing intended for the KIN'NOTé customer file. KIN'NOTé is the sole recipient of this data. They are used for internal commercial purposes and are not transferred to a third party under any circumstances.

In accordance with the law "Informatique et Libertés" of January 6, 1978 amended in 2004, the customer  benefits from a right of access and rectification to the information which concerns him, right  that he can  exercise by contacting KIN'NOTé by email at the address: contact@kinnote.fr.

By checking the box "accept the general conditions of sale" during the ordering process, the customer declares to fully and unreservedly accept all of these general conditions of sale and use.

 

 

Object

The KIN'NOTé website and shop. are sites of  commerce and e-commerce for the sale of customizable made-to-measure and small-scale clothing, accessories and all related objects. KIN'NOTé reserves the right to modify some of these provisions at any time.

 

Orders

The terms and conditions for ordering products on the site are as follows:  :

 

Customers warrant that they are fully entitled to use a  bank card and that this bank card gives access to sufficient funds to cover all the costs resulting from the use of KIN'NOTé services.

In addition, in accordance with the law, minors wishing to make a purchase from KIN'NOTé must be authorized and accompanied by a parent.

 

In order to create and personalize his product, the customer must respect  one or  several of the following steps:

 

- choice of model

- choice of fabric

- choice of color

- choice of length when this customization is offered

-  supplies of the measurements necessary for the appropriate manufacture of the product when the product is offered in small quantities.

 

  KIN'NOTé makes sure to provide the precise indications necessary for taking these measures and to assist the customer at his request by telephone or email in this operation For the models indicated, Kin'noTé will organize  taking measurements  needed by the customer. KIN'NOTé can in no way be held responsible for the inaccuracy of the measurements and the resulting anomalies. However, KIN'NOTé will demonstrate its best efforts to resolve any problems by offering, for example,  limited number of alterations.

 

As for the clothes  made to measure presented on the KIN'NOTé website is responsible for taking measurements with the customer and organizing the necessary and sufficient fittings for the proper production of the garment.

KIN'NOTé reserves the right to accept an order for made-to-measure clothing within the limits of its ability to organize the measurements.

​ The order is taken into account when the payment is made. KIN'NOTé reserves the right to reject or cancel an order in the event of payment not being made within a reasonable time after receipt of the order.

KIN'NOTé is deemed to have sufficient stock of raw materials to meet orders. However, KIN'NOTé undertakes to alert the customer as soon as possible in the event that raw materials or accessories should be modified. If the modification proposed by KIN'NOTé should not suit the customer, the order would then be canceled and refunded.

 

Price

The prices of the products are indicated in euros ttc (all taxes included) including French VAT and do not include preparation and shipping costs unless otherwise stated in the product description sheet. For countries located outside the Euro zone or outside Europe, exchange fees and customs fees are not taken in charge by Kin'noTé.

Insofar as possible, Kin'noTé will indicate to the concerned customers the approximate amount of the exchange and the customs charges.

​ .For the delivery  of a product with a sales price lower than 100 € in France, and for all deliveries outside France , Kin'noTé will apply a flat rate of delivery relating to the article or its weighKIN'NOTé reserves the right to modify its prices in compliance with the law. The products are invoiced on the basis of the tariffs in force at the time of the recording of the orders.

The products offered for sale remain the property of KIN'NOTé until final and full payment of the price.

 

Samples

​ It is possible to order a maximum of 2 samples per order. Upon receipt of this request, KIN'NOTé will send  a fabric sample by post subject to availability of the requested fabric.

 

Payment

​ The terms of payment for  small clothes  measurement are those made available by the Etsy website.

For made-to-measure clothing, KIN'NOTé accepts checks and cash payment in euros only . In the latter case, KIN'NOTé will issue an invoice  to the client .

Depending on the amounts concerned and exclusively for made-to-measure garments, KIN'NOTé reserves the right to propose a payment schedule. In all cases, no order will be accepted without prior payment of 30% of its total amount.

 

Delivery

​ KIN'NOTé has parcels delivered everywhere in mainland France and the euro zone. Others countries deliveries are accepted after request to Kin'noté. United Kingdom customer will have to pay customs amount.

The product purchased by the customer will be delivered within a maximum of 30 working days from the date of the order in the European zone. for made-to-measure garments, the delivery time will be  specified on the estimate provided to the customer. The acceptance of this estimate is worth  acceptance of the deadline. However Kin'noted  can in no way be held responsible for the  delay in delivery which would be  chargeable to the customer by  fault  appointment or by  customer pushback  of the agreed appointment date for a fitting, for example.

Upon receipt of the order and after providing information relating to the customer's measurements, Kin'noté will provide a precise delivery time. Delivery is deemed to have been made as soon as the product is delivered to the customer by the carrier according to the control system used by this last.

 

Right of withdrawal and customer return

​ In accordance with the law, KIN'NOTé products being manufactured at the request and to the measurements of the customer, no right of withdrawal can apply. A product made on estimate cannot be refunded.

 

Intellectual property

​ All the models and products, drawings and illustrations presented on the Kin'noté sites are reserved under copyright, trademark law, model law.

 

Responsibility

The photos are communicated for illustrative purposes and cannot be considered as contractual, it being understood that the products will be adapted to the measurements and according to the morphology of the customer in agreement with this one.

Kin'noté cannot be held responsible for damage of any kind, whether material, immaterial or bodily, which would result from the misuse of the products sold.

The liability of 'Kin'noté will in any case be limited to the amount of the order.

Kin'noté cannot be held responsible for the non-performance of the contract concluded in the event of out of stock or unavailability of the product, force majeure, disruption or total or partial strike, in particular of the postal services and means of transport,

 

Modification of the general conditions of sale

​ Kin'noté reserves the right to modify the general conditions of sale and use. Any new version will be accessible on the Kin'noté sites and will be applicable as of its publication on the sites.

In the event that certain provisions of the general conditions of sale and use are declared illegal or unenforceable by a court decision, the other provisions will remain in force.
